RayPass

These terms are the agreement between you and SETCODER LIMITED (“RayPass”, “we”, “us”), a company registered in England and Wales, covering the RayPass app and the raypassapp.com website. By creating an account or using RayPass, you accept them. They are deliberately written in plain English, and nothing in them takes away the rights you have as a consumer under the law of the country you live in.

1. What RayPass is

RayPass is a digital loyalty wallet. It replaces the paper stamp cards you would otherwise carry around: you show a QR code, a venue adds a stamp, and once a card is full you claim the reward that venue has promised. It is free for you to use. We are not a café, a salon or a shop, and nothing is sold to you through the app.

2. The venues are independent businesses

Every loyalty programme in RayPass belongs to the venue that created it, not to us. The venue decides how many stamps a reward costs, what the reward is, when it expires, whether the terms change and who receives a coupon. We provide the tools; we do not run the venue, we do not check its products or its premises, and we cannot make it honour a reward or stay open.

If a venue refuses a reward you have properly earned, tell us at support@raypassapp.com. We will look into it and we can remove a venue from RayPass — but the claim over the reward itself is yours against that venue.

3. Who can use RayPass

You must be at least 16 years old and able to enter into a contract. One person, one account: opening several accounts to earn more from the same visits is not allowed (section 7). Keep your sign-in details to yourself — anything done through your account while it is signed in is treated as done by you.

4. Your account

You sign up with an email address, or with Google, Apple or Facebook. Keep the email address current: it is how we reach you and how you get back in if you lose access. Your display name and photo can be changed at any time under Profile › Personal Information, and you can close the account whenever you like (section 11).

5. Stamps, rewards, coupons and levels

These rules apply everywhere in RayPass, on top of whatever each venue sets for its own programme:

  • Stamps, rewards, coupons and levels have no cash value. They cannot be exchanged for money, and they are not property, credit or a means of payment.
  • They belong to the account that earned them. They cannot be sold, transferred, gifted or pooled with another account.
  • A reward is earned once your card holds the stamps that venue's programme requires, and it is claimed in person, at that venue.
  • Venues may set expiry dates on stamps, rewards and coupons. Where one applies it is shown on the card or coupon in the app.
  • A venue can change or end its programme at any time. The change appears in the app as soon as the venue makes it, and stamps held at a venue that closes or leaves RayPass may no longer be claimable.
  • Where a stamp is added by mistake — a double scan, the wrong card — the venue or we may correct it.

RayPass levels, points and any free stamps we hand out are ours rather than any venue's. We may change how they work, and we will say so in the app before we do.

6. Your QR code

The code on your Member Pass identifies your account. It is rebuilt every few minutes and a scan is refused once the code is more than three minutes old, which is what makes it safe to show on a screen — but it is still yours. Do not send it to anyone and do not let someone else collect stamps with it. The same applies to a pass you have added to Apple Wallet or Google Wallet.

7. Fair use and fraud

RayPass only works because a stamp means somebody actually turned up. So you must not:

  • collect stamps without a genuine visit and a genuine transaction, by whatever method;
  • run more than one account, or use an account that is not yours;
  • copy, share or sell your QR code, your pass or a coupon issued to you;
  • exploit a bug, a mispriced programme or a mistake by staff instead of reporting it;
  • interfere with the app or our servers, scrape data from them, or try to reach parts of the system that are not yours;
  • write reviews that are false, abusive, or paid for by anyone.

Where we find abuse we may suspend or close the account and cancel the stamps, rewards and coupons that came out of it. Where it is deliberate and obvious we act immediately; otherwise we ask you about it first. You can dispute any decision at support@raypassapp.com and we will look at it again.

8. Reviews and anything else you post

You can rate and review a venue you collect at. Reviews are checked before they appear, and we will not publish anything unlawful, abusive, off-topic, or written about a venue you have never visited. A published review shows your display name and profile photo, and the venue can reply to it publicly. You keep ownership of what you write and you can edit or delete it at any time; while it is published, you give us permission to show it in RayPass and on our website. Write what you actually experienced — anything else is unfair both to the venue and to everyone reading.

9. Notifications and messages

With notifications on, you hear from us when a stamp lands, a reward is ready or a coupon is about to expire, and you may hear from venues whose cards are already in your wallet. The limits on marketing messages are set out in our Privacy Policy. Turn notifications off in your device settings whenever you like — the rest of the app carries on working without them. Messages about the account itself, such as a password reset or a change to these terms, are sent by email and cannot be switched off while the account is open.

10. The app itself

We work to keep RayPass available and correct, but we do not promise that it will always be up, that every venue's details will be perfectly current, or that it will run on every device. We update the app, add and remove features, and occasionally take it down for maintenance. RayPass is free to use; if we ever charge for something we will make that clear before you pay, and you will be free to say no.

11. Ending it

You can close your account at any time from Profile › Personal Information › Delete Account. It takes effect immediately and cannot be undone: you will not be able to sign in again, and the stamps, rewards and coupons on the account become inaccessible. What happens to the underlying records is set out in our Privacy Policy. We may suspend or close an account for a serious or repeated breach of these terms, or where the law requires it, and we will tell you why unless we are prevented from doing so. We may also stop offering RayPass altogether, with reasonable notice in the app.

12. Our responsibility, and its limits

We are responsible for loss we cause by breaking this agreement or by failing to use reasonable care and skill — but not for loss that was not foreseeable, and not for loss caused by a venue rather than by us. Because RayPass is free and rewards have no cash value, we are not liable for the value of stamps or rewards that a venue declines to honour or that expire.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you use RayPass for business rather than personally, our total liability to you is capped at £100.

13. Changes to these terms

We may change these terms — for a new feature, a change in the law, or a problem we did not foresee. Where a change matters to you we will tell you in the app before it takes effect, and continuing to use RayPass afterwards means you accept it. If you would rather not, close your account. The current version is always in the app under Profile › Terms of Service, and at raypassapp.com/terms.

14. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Turkey, or in the EU or EEA, you keep the protection of the mandatory consumer-law rules of your own country and you can bring a claim there. Before it gets that far, please write to support@raypassapp.com — almost everything is settled in a couple of messages.
